1. Introduction

These Terms of Service ("Terms") govern the relationship between you ("Client", "you") and ARTHUR DELIVERS LTD (Company No. 17035470), trading as Arthur Tyne Express, registered at 31 Greenway, Newcastle Upon Tyne, United Kingdom, NE5 1SU ("we", "us", "Company"). By using our website or engaging our services, you agree to these Terms.

2. Services

We provide road freight transport and logistics services, including but not limited to: same-day courier, express delivery, light haulage, domestic and commercial removals, and contract logistics. All services are subject to availability and our acceptance of your booking.

3. How to Place an Order

A booking is confirmed only when we provide written or verbal confirmation of the job details, price, and collection/delivery schedule. Submission of a contact form or enquiry does not constitute a confirmed booking.

4. Pricing & Payment

  • Prices listed on our website are starting rates and may vary depending on distance, weight, dimensions, access requirements, and urgency.
  • A final quote will be provided before any work commences.
  • Payment is due upon completion of the service unless alternative terms have been agreed in writing.
  • We accept payment by bank transfer and other methods as communicated at the time of booking.
  • All prices are in GBP (£) and inclusive of VAT where applicable.

5. Cancellations & Refunds

  • Before collection: You may cancel a booking free of charge at any time before our driver has departed for the collection address.
  • After departure: If our driver is already en route to the collection point, a cancellation fee of up to 50% of the quoted price may apply to cover incurred costs.
  • After collection: Once goods have been collected, the full service fee applies. Refunds will only be considered if the service was not delivered as agreed due to our fault.
  • Refund processing: Approved refunds will be processed within 14 working days to the original payment method.

6. Delivery & Fulfilment

  • We will make every reasonable effort to collect and deliver within the agreed timeframe.
  • Delivery times are estimates and not guaranteed unless explicitly stated in a written agreement. We are not liable for delays caused by traffic, weather, road conditions, or other circumstances beyond our control.
  • The Client is responsible for ensuring that the collection and delivery addresses are accessible and that someone is available to hand over or receive the goods.

7. Liability & Insurance

  • All goods in transit are covered by our goods-in-transit insurance. The maximum liability per consignment is limited to the terms of our insurance policy. Details are available on request.
  • We are not liable for damage caused by inadequate packaging provided by the Client.
  • Claims for loss or damage must be reported within 48 hours of delivery, in writing, to [email protected].
  • Our total liability shall not exceed the value of the service fee paid for the specific job in question, except where covered by insurance.

8. Customer Complaints & Dispute Resolution

If you are dissatisfied with any aspect of our service:

  • Step 2: We will acknowledge your complaint within 2 working days and aim to resolve it within 14 working days.
  • Step 3: If you are not satisfied with the resolution, you may seek mediation or pursue legal remedies under the laws of England and Wales.

9. Prohibited Goods

We do not transport illegal substances, hazardous materials (unless pre-agreed with appropriate documentation), firearms, live animals, or any items prohibited by UK law.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the revised Terms.
